Montana Real Estate (Property) Power of Attorney Form

A Montana Real Estate (Property) Power of Attorney is a legal resource that empowers anyone who executes it (called the Principal) to achieve a number of objectives in relation to their real property. As stated by the state law provision § 72-31-339, Power of Attorney arrangements concerning real estate can encompass an Agent acting on the Principal’s behalf to buy, lease, manage, insure, purchase supplies for, and/or mortgage a property, among other tasks.

Signing Requirements (§ 72-31-305) – Either a Notary Public or “other individual authorized by law to take acknowledgments” must see that the Principal signs the Montana Real Estate (Property) Power of Attorney form in legally-compliant manner.
