Montana Limited (Special) Power of Attorney Form
The Montana Limited (Special) Power of Attorney (POA) is referred to as a “special” type of POA as it sets up special legal guidelines for an Agent to act on behalf of a Principal (the party who brings about this arrangement). Dissimilar to an all-encompassing POA, this type of form places firm restrictions on the Agent’s powers which cannot be compromised with. Therefore, if a Principal seeks legal assurance that their Agent may only use the decision making powers they bestow them in the limited number of ways they specify, they are recommended to use this form.

Signing Requirements (§ 72-31-305) – Every Limited Power of Attorney is required by the state of Montana to be signed by the Principal (or by someone they delegate this responsibility to) before a Notary Public or another individual authorized to take acknowledgements.
